No-Fault and Fault Divorce in Tennessee
Tennessee offers spouses the opportunity to declare irreconcilable differences when requesting a divorce. The divorcing parties must show they have lived apart for two years and agree on child custody, support, division of property, and division of any debts before they can request a divorce due to irreconcilable differences, also known as a no-fault divorce.
It takes at least 60 days before a no-fault divorce request is granted in Tennessee and can take 90 days if there are children involved. This period is to make sure neither party changes his or her mind.
